As a provider of web hosting and other Internet-related services,
AlfainHost offers its customer (also known as "Subscribers") and their
customers and users the means to acquire and disseminate a wealth of
public, private, commercial and non-commercial information. AlfainHost
respects that the Internet provides a forum for free and open discussion
but at the same time AlfainHost reserves the right to suspend or cancel a
customers access to any or all services provided by AlfainHost when
AlfainHost decides that the account has been used inappropriately.
In AlfainHost servers or networks, it is prohibited to do the following
actions. These are also known as abusive activities. Such actions may
cause suspension or termination of service without any notice.
1) Pirated Software
You are not allowed to upload any of pirated or illegal software. Warez
forums are also not allowed in AlfainHost servers or network.
2) IRC
We currently do not allow IRC or IRC bots to be operated on our servers.
3) Server Abuse
Any attempt to undermine or cause harm to a server or customer of
AlfainHost is strictly prohibited. As our customer you are responsible for
all your accounts.
4) Unsolicited Bulk/Commercial Email/Bulk Email
The use of AlfainHost servers and networks to transmit unsolicited
bulk/commercial email (also know as spam) is strictly forbidden. Under no
circumstance is the transmission of spam acceptable or tolerated. Any
client caught explicitly spamming from our servers or networks will have
their account immediately terminated & without notice.
5) Adult Content
Under no circumstance is adult content permitted on AlfainHost servers or
networks. All adult oriented pictures, videos, links, written content and
similar is strictly prohibited.
6) Forbidden Websites
Prime bank or bank debenture-related sites, shipping websites, lottery
sites, muds or online RPGs, hate sites, hacker-related sites, sites
promoting illegal activity, IP scanner or other hacking tools, mail
bombing or spam scripts, or forums and websites that distribute or promote
warez content are expressly forbidden.
7) File Sharing
Bit torrent applications, trackers, and clients as well as any
file-sharing/peer-to-peer activities are forbidden.
8) Server Overload
The abovementioned services / web content create undue system load on our
servers and should only be run in a dedicated server environment. All
violations will be shut down immediately and may result in account
suspension and/or termination.
9) Cron Jobs
A cron job should not execute more frequently than once every 15 minutes.
10) Copyright Violations
Site5 will respond to all reports of infringement that are formatted in
accordance with the Digital Millennium Copyright Act and any other
applicable copyright laws. Notices of infringement that do not comply with
this act will not be processed. We will act in accordance with the DMCA
when handling infringement reports.
11) Audio/Video Streaming
Audio/Video Streaming is not hosting friendly. As such, AlfainHost does
not allow any streaming of audio or video content. Offending accounts will
be suspended without noticed or terminated.
12) Large File Policy
AlfainHost is not for file hosting and distribution - as such, customers
may not host any files larger than 100MB in size that are observed to be
available for the sole purpose of download. Such files include but are not
limited to .ISO, audio/video files, .EXE files.
13) Obscene Speech or Materials
Using AlfainHost network to advertise, transmit, store, post, display, or
otherwise make available child pornography or obscene speech or material
is prohibited. AlfainHost is required by law to notify law enforcement
agencies when it becomes aware of the presence of child pornography on or
being transmitted through its network.
14) Defamatory or Abusive Language
Using AlfainHost network as a means to transmit or post negative,
defamatory, harassing, abusive or threatening language.
15) Forging of Headers
Forging or misrepresenting message headers, whether in whole or in part,
to mask the originator of the message.
16) Illegal or Unauthorized Access to Other Computers or Networks
Accessing, illegally or without authorization, computers, accounts or
networks belonging to another party, or attempting to penetrate security
measures of another individual's system (often known as "hacking"). Also,
any activity that may be used as a precursor to an attempted system
penetration (i.e., port scan, stealth scan or other information-gathering
activity).
17) Distribution of Internet Viruses, Worms, Trojan Horses or Other
Destructive Activities
Distributing information regarding the creation of and sending Internet
viruses, worms, Trojan horses, pinging, flooding, mail bombing or denial
of service attacks. Also, activities that disrupt the use of or interfere
with the ability of others to effectively use the network or any connected
network, system, service or equipment.
18) Facilitation a Violation of this AUP
Advertising, transmitting or otherwise making available any software,
program, product or service that is designed to violate this AUP, which
includes the facilitation of the means to spam, initiation of pinging,
flooding, mail bombing, denial of service attacks and piracy of software.
19) Fraudulent Activities
It is strictly prohibited to use the AlfianHost service to make fraudulent
offers to sell or buy products, items, or services, or to advance any type
of financial scam such as "pyramid schemes" and "chain letters."
20) Data Collection
Use of the AlfainHost service to collect, or attempt to collect, personal
information about third parties without their knowledge or consent is
prohibited.
21) Chat Scripts or Shout cast
Accounts may not run chat scripts of any kind. This includes shout boxes
and chat rooms but is not limited to just them.
22) Free Hosting
Reseller account holders are not allowed to sell free web hosting
services.
23) HYIP / Forex Site
Valid Hyip or forex websites are allowed till we don't receive any fraud
complain.
24) DDOS Attack
In case any of website faced DDOS Attack, AlfainHost reserves the right to
suspend/terminate the website without any notice.
Your use of this service is at your sole risk, we regularly make backups
of your data and our hard disks are multi array, but still we take no
responsibility of your data, AlfainHost would be not responsible for any
data loss.
You agree to supply appropriate payment for the services received from
AlfainHost, in advance of the time period during which such services are
provided. You agree that until and unless you notify AlfainHost of your
desire to cancel any or all services received, those services will be
billed on a recurring basis. This includes when accounts are suspended.
However, after the customer notifies AlfainHost of his or intent to resume
service, invoices will be manually generated and payment expected for the
time the account was suspended.
1) Payment Confirmation
After payment it is customers responsibility to check the payment
confirmation email, if the customer had not received the payment
confirmation email than customer should inform AlfainHost.
2) After Suspension
It is customers responsibility to create backups if customer knows that he
cannot pay the fees of upcoming period, AlfainHost would be not
responsible for the data of suspended or terminated accounts.
3) Reversal of Payment
In case of payment reversal or charge back AlfainHost reserve the right to
suspend/terminate the service without any notice.
4) Price Change
AlfainHost reserves the right to change the price of any product, that is
for both new and existing customers.
AlfainHost offers its clients a 99.9% network uptime guarantee for
customer satisfaction purposes and also to ensure that your business is
running problem free. AlfainHost will try to maintain maximum uptime.
Should we fail to deliver this for any given calendar month, your account
will be refunded a pro-rated amount for the duration of excessive
downtime.
1) Downtime Due to Client
AlfainHost is not responsible for any downtime caused by the client.
2) Official Downtime
Scheduled network maintenance downtime or downtime resulting from upstream
AUP violations is not covered by the SLA. In short such downtime are not
included in official downtime.
3) 1 Month Free Hosting
In any case AlfainHost is not able to maintain 99.9% uptime client can ask
1 month free hosting, such request can be made within 7 days of downtime.
If you don't need any of AlfainHost service, then you can cancel the
accounts at any time.
1) Money Back Guarantee
We offer a 60 Day Money back guarantee for only shared and reseller
hosting.
2) Eligibility
Only yearly or biannually payments are refundable within 60 days of order.
3) No Guarantee
We don't offer any money back guarantee to domain, ssl and vps accounts.
4) Refunds
If client has retained the services for one year and has pre-paid
AlfainHost for such services, refunds will be issued for any unused full
month of the services, upon client's request. Therefore, if client's
account is cancelled at any point during the one-year term, client will be
entitled to a refund for the months remaining, after notice given by the
25th day of the preceding month.
5) Suspended/Terminated Account
No refund would be provided to those accounts which are suspended or
terminated.
6) Cancellation
We don't provide any refund on cancellation unless you are eligible for
Money Back Guarantee.
We reserve the right to refuse, cancel or suspend service, at our sole
discretion.
AlfainHost shall not be responsible for any claimed damages, including
incidental and consequential damages, which may arise from AlfainHost
servers going off-line or being unavailable for any reason whatsoever.
Furthermore, AlfainHost shall not be responsible for any claimed damages,
including incidental or consequential damages, resulting from the
corruption or deletion of any web site from one of AlfainHost servers. All
damages shall be limited to the immediate termination of service.
AlfainHost cannot be held liable for system down time, crashes or data
loss. We cannot be held liable for any predicated estimate of profits
which a client would have gained if their site was functioning. Certain
services provided by AlfainHost are resold. Thus, certain equipment,
routing, software and programming used by AlfainHost are not directly
owned or written by AlfainHost. Moreover, AlfainHost holds no
responsibility for the use of our clients' accounts. Failure to comply
with any terms or conditions will result in the automatic deactivation of
the account in question. We reserve the right to remove any account,
without advance notice for any reason without restitution, as AlfainHost
sees fit.
By activating your account with AlfainHost, you agree to the above
policies and disclaimer. Upon requesting activation of an account, you are
required to accept these policies, guidelines and disclaimer, and a copy
of your acceptance is forwarded along with your activation request to be
maintained with your account information.
